1. services provided

opticbyte provides web design and development, mobile application development, backend development, automation solutions, and related digital services. we work closely with clients to deliver custom solutions tailored to their specific needs.

2. project engagement

all projects begin with a consultation to understand your requirements. we provide detailed proposals outlining scope, timeline, and costs. work begins upon signed agreement and initial payment.

changes to project scope may affect timeline and cost. we'll discuss any modifications with you before implementation.

3. payment terms

payment schedules are outlined in individual project agreements. typically, we require a deposit to begin work and progress payments throughout the project.

invoices are due within 30 days of receipt. late payments may result in project delays or suspension of services.

4. intellectual property

upon full payment, you own the final deliverables created specifically for your project. we retain rights to our general methodologies, frameworks, and reusable components.

we may showcase completed work in our portfolio unless otherwise agreed. we respect confidential information and will sign ndas when required.

5. client responsibilities

timely provision of content, feedback, and approvals is essential for meeting project timelines. delays in client responses may affect delivery schedules.

you're responsible for providing accurate information and ensuring you have rights to any materials you provide.

6. warranties and limitations

we deliver services with professional care and skill. we'll address any issues that arise during the agreed warranty period at no additional cost.

our liability is limited to the amount paid for services. we're not responsible for indirect damages or losses resulting from service interruptions.

7. maintenance and support

ongoing maintenance and support services are available separately. we recommend regular updates and backups for optimal performance and security.

third-party services and platforms may have their own terms and limitations that affect your project.

8. termination

either party may terminate services with written notice. you'll be responsible for payment of work completed up to the termination date.

we reserve the right to terminate services for non-payment or breach of these terms.

9. governing law

these terms are governed by the laws of new york state. any disputes will be resolved through good faith negotiation or mediation.
